Ex-SABC boss Hlaudi Motsoeneng fails in bid to overturn court order to repay R11 million

The Constitutional Court has dismissed former South African Broadcasting Corporation (SABC) chief operating officer Hlaudi Motsoeneng‘s application to appeal an earlier ruling ordering him to pay back R11.5 million.

HLAUDI MOTSOENENG LIABLE TO PAY R11.5 MILLION SUCCESS FEE

As previously reported by The South African, Motsoeneng was fired by the SABC in June 2017 after an internal disciplinary hearing found him to have lied about his qualifications.

He lost his title of chief operations officer at the SABC after a court set aside his appointment. He was also found guilty of bringing the SABC into disrepute and causing irreparable damage.

In December 2011, the Gauteng High Court in Johannesburg ruled that Motsoeneng should pay R11.5 million back to the SABC with interest calculated at 15.5% annually. The court found that the decision to pay Motsoeneng R11.5 million was unlawful and invalid.

The interest is calculated from 13 September 2016 to the date of payment. In total, Motsoeneng will have to pay just over R18 million.

In addition, in 2022, the SABC and the Special Investigating Unit (SIU) also ordered him to pay back over R2.5 million in ‘gratitude’ funds handed over to music legends during his time at the public broadcaster. 

SIU WELCOMES COURT RULING

The SIU has welcomed the decision and said it sees the it as a positive step as it clears the way to pursue the outstanding amount from Motsoeneng.

The investigating unit has already recovered R6 476 512 from the former COO’s pension benefits.
